By using Logarty, you agree to these Terms and conditions of use, along with our Talk guidelines.

If you join Logarty, by registering with the site you accept these Terms and conditions of use and our Talk guidelines.

We may amend or add to these Terms and conditions of use without notice so please check back from time to time to ensure you are still happy with all the elements. These Terms and conditions of use are effective from November 2013.

1. Copyright
The Logarty website, and all its content, is copyright Logarty. All rights reserved. Reproduction of our content in any form is prohibited unless you have our specific permission.

2. Registration
When you register with Logarty, you are stating that you are over 18 years of age or are a minor, aged over 13, with parental consent to register. By joining the site, you agree to this.

3. Content contributed by you
3a. Logarts
We are grateful to the people who agree to be interviewed for logarts: Logarty wouldn't exist without you and we recognise that these are your personal stories. You are, of course, free to share your stories in your own way as you wish, as long as it is not in the form we have written it as a logart.

You can remain anonymous in a logart and we will change names and other identifying features to protect your privacy. If your logart is anonymous, we will not store real names or identifying details in our official records.

If we interview you for a logart, we will send you the edited version for approval prior to publishing. However, once a logart is written and approved (for factual accuracy), we own the content, and it is subject to copyright as in (1), above. This means that you can't republish the story as we have written it elsewhere.

We have the right to unpublish, edit or re-use logarts for any purpose, whether commercial or otherwise, without payment to you, unless we have specifically agreed otherwise in writing.

You agree that any story you tell in a logart interview is your story to share. You represent, warrant, and covenant that anything you tell us in an interview will not:
  • violate or infringe in any way upon the rights of others
  • impersonate another or be unlawful, threatening, abusive, libellous, defamatory, invasive of privacy or publicity rights, obscene, harassing or otherwise objectionable
  • contain a formula, instruction or advice that could cause harm or injury
  • mean that the licensed use by us hereunder would result in us having any obligation or liability to any party.

3b. User-generated content (UGC)
UGC refers to content you submit to Logarty. This includes any comments on content and any posts on Logarty talk, including stories on the Storyboard. We have the right to publish, edit, share, reject or delete any content that is submitted to Logarty, whether in the form of messages in Logarty talk (including stories on the Storyboard), text, photos, illustrations, comments, audio material, video material and/or any other materials uploaded or sent by you. This includes content sent via email, via the Contact us form on the site or by any other means.

We have the right to unpublish, edit or re-use UGC for any purpose, whether commercial or otherwise, without payment to you, unless we have specifically agreed otherwise in writing.

By submitting UGC to Logarty, simultaneously with such posting you automatically grant to us a worldwide, fully-paid, royalty-free, perpetual, irrevocable, non-exclusive, fully sublicensable, and transferable right and license to use, record, sell, lease, reproduce, distribute, create derivative works based upon (including, without limitation, translations), publicly display, publicly perform, transmit, publish and otherwise exploit the UGC (in whole or in part) as Logarty, in its sole discretion, deems appropriate. We may exercise this grant anywhere and in any format, media or technology now known or later developed for the full term of any copyright that may exist in such UGC.

Subject to the rights and license you grant to us under these Terms and conditions of use, you retain all your right, title and interest in your UGC submissions. This means that copyright of your content will remain with you and that you can continue to use the material in any way, including allowing others to use it.

You agree that you will not submit any content that is protected by copyright, trademark, patent, trade secret, moral right, or other intellectual property, personal, contractual, proprietary or other right owned by a third party without the express permission of the owner of the respective right. You are solely liable for any damage resulting from your failure to obtain such permission or from any other harm resulting from UGC that you submit. You represent, warrant, and covenant that you will not submit any content that:

  • violates or infringes in any way upon the rights of others, including, but not limited to, any copyright, trademark, moral right, or other third party right of any person or entity
  • impersonates another or is unlawful, threatening, abusive, libellous, defamatory, invasive of privacy or publicity rights, obscene, harassing or otherwise objectionable
  • contains a formula, instruction, or advice that could cause harm or injury
  • the licensed use by us hereunder would result in us having any obligation or liability to any party.

We rely on you to present us with UGC that contains accurate and factual material. We assume no responsibility for the accuracy of information provided on Logarty by anyone.

Notwithstanding the foregoing, you waive any and all claims you may now or later have in any jurisdiction to so-called "moral rights" or rights of "droit moral" with respect to the UGC. 

We reserve the right to display advertisements in connection with your content and to use your content for advertising and promotional purposes.

4. Disclaimer
4a. Information or advice on Logarty
Please be aware that the information contained on Logarty, whether in logarts, articles, UGC or any other format, does not constitute any form of advice or recommendation by Logarty and is not intended to be relied upon by users as a substitute for obtaining professional advice.

All views expressed in logarts and UGC are the individual's own and opinions expressed by users are not endorsed by Logarty. Please refer to our Talk guidelines for more information.

4b. Errors
While we check our content carefully, and make the effort to post-moderate UGC as soon as possible, mistakes can happen. If you see something that you believe is in error, or that is out of date, please use the Contact form to get in touch with us.

All content on Logarty, including the forum, has been included in good faith. However, no warranty is given as to its accuracy and Logarty does not accept any liability for errors or omissions.

5. Your privacy
We use an automated moderation service on Logarty, called Mollom, which analyses the information you use to register with our site, along with screening messages you post, in order to detect and prevent spam. This information is stored temporarily in Mollom's database in order to compare data to assess whether users and/or messages are genuine. Please see our Privacy policy for more information about Mollom.

Other than the information that goes to Mollom, we will not pass on the personal information you give us when you register unless you consent to us doing so or we are specifically required to by law.

If Logarty is sold to a third party, we will put notice of this on the site to give registered users the opportunity to cancel their registration if they choose.

5a. Information we ask you to give us
When you register with Logarty, we ask for limited details, such as your name and a contact email. This is for a number of reasons. Firstly, it's important that only registered users can contribute comments or post on Logarty talk – so that, for instance, a user who is posting offensive or illegal material can be blocked. For more about this, see our Talk guidelines.

We also ask you to register before you can contact us via email or the contact form on the website. This is so that we know who is using Logarty and so that we can reply to you.

5b. How your information may be used
If you sign up for our email newsletter, we will use the email you have submitted to send this. We will not sell your email addresses to third parties.

We use MailChimp to send out our newsletters and a list of all those who have subscribed to the Logarty newsletter will be stored on their site solely for this purpose. This will include the information you give to us when you join Logarty: your name and email address. MailChimp will not sell or rent this list to anybody.

5c. Cookies
Logarty does use some cookies, which are small files stored on your browser. We make you aware of this with our information pop-up and our page about how cookies are used on the site. You have the option to turn off cookies on your computer but it may affect your experience of Logarty.

5d. Security: how your personal information will be stored
Logarty is hosted on a secure server based in the UK. Our database is password protected and we endeavour to keep your details as secure as possible. We ask you for as little personal information as possible to register on Logarty: just your name and email address.

6 Limitation of liability
Neither Logarty nor any of its representatives will be liable for loss or damage arising out of or in connection with your use of Logarty or any information contained in the site. Any claims will be dealt with under UK law.
